Selling your Clearwater, FL house in foreclosure: how Florida's court process works in Pinellas County, how long you have, and how a cash sale pays the lender and ends the case. Written offer in 24 hours.
A foreclosure in Clearwater begins with a lawsuit. Florida is a judicial foreclosure state, which means the lender must file a complaint in the Pinellas County circuit court, serve you, and win a judgment before the Clerk can sell the house. The first visible sign is often a process server at the door or a notice of lis pendens, a document recorded in the county's official records announcing that the property is the subject of a lawsuit. From that moment the mailbox fills with letters from attorneys and investors, many of them inaccurate about how much time you have.
Clearwater Cash Buyers buys houses from owners at every stage of a Florida foreclosure, from the first missed payments to the weeks before a scheduled sale. We pay the lender's full payoff at closing from the purchase price; the lender's attorney then cancels the sale and dismisses the case, and you receive whatever equity remains. This page is written for the owner of the home. It explains the stages of the process in Pinellas County, the rights Florida law gives you, and how a cash sale fits inside the court's timeline.
How it works

How a Florida foreclosure moves through the Pinellas County court
After several missed payments the servicer sends a notice of default and, under most mortgages, a breach letter giving you time to cure. If the loan is not brought current, the lender's attorney files a complaint in the Sixth Judicial Circuit and records a lis pendens. You have twenty days after service to respond. If you do not, or after the court rules on the case, the lender moves for a final judgment of foreclosure, which sets the amount owed and a sale date, by statute between 20 and 35 days after the judgment unless the parties agree otherwise. Pinellas County foreclosure sales are conducted online by the Clerk of the Circuit Court. After the sale the Clerk files a certificate of sale, which is the point at which your right to pay off the loan ends, and if no valid objection is filed within ten days, a certificate of title to the winning bidder. The whole sequence takes months, and contested cases take longer. That time is the owner's most valuable asset, because a sale that pays the lender can happen at any point before the certificate of sale is filed.
Your right to pay off and stop the sale
Florida law (section 45.0315 of the Florida Statutes) gives the owner the right to redeem the property by paying the amount in the judgment, plus interest and costs, at any time until the Clerk files the certificate of sale or until a later deadline set in the judgment, whichever is later. Before the judgment, paying off means paying the full remaining loan balance the lender has declared immediately due, plus the lender's reasonable fees and costs. After that later point, there is no redemption in Florida. A sale of the house to a cash buyer is simply one way of making that payment: the title company obtains the payoff figure from the lender's attorney, pays it from the purchase price at closing, and the lender's attorney files to cancel the sale and dismiss the case. Equity above the payoff, liens and closing adjustments is wired to you.
Why selling usually beats letting the sale happen
At a Clerk's auction the opening bid is set by the lender, not by what the house is worth, and the lender frequently takes the property back. Any equity you have is at the mercy of a bidding process you do not control. Worse, if the sale price does not cover the judgment, Florida allows the lender to seek a deficiency judgment against you for the shortfall. For a one-to-four unit residential property the lender must bring that claim within one year after the certificate of title is issued, and for an owner-occupied home the deficiency is capped at the judgment amount minus the property's fair market value on the sale date. A negotiated sale that pays the loan in full avoids the deficiency entirely and gives you the net proceeds in your contract. An auction can also produce surplus funds for the former owner after higher claims are paid, but through a slower claim process at the Clerk and usually at a lower price. If it closes before a judgment is entered, it also keeps a foreclosure judgment and sale off your credit history; a judgment already entered is not erased.
What a cash sale looks like when a case is pending
Tell us the case status: whether you have been served, whether a judgment has been entered, and the sale date if one is set. We look at the house within a day or two, and you receive a written offer within 24 hours of the visit. If you accept, the title company requests the payoff from the lender's attorney, which includes the judgment amount, interest, and attorney fees and costs, and schedules closing ahead of the sale date. We buy as-is: the deferred maintenance that often comes with a long default, a roof that an insurer flagged, a flooded first floor from the 2024 storms, all of it is priced into the offer. We pay the customary closing costs, and there is no commission. If the purchase price cannot cover the payoff and other liens, the lender must agree to accept less (a short sale), and we will tell you that early rather than let the clock run.
Other options to weigh alongside selling
A sale is not the only route and it is not always the best one. If you want to keep the Clearwater home, a loan modification or repayment plan through your servicer, if the servicer approves it, can bring the loan current. A reinstatement by paying the past-due amount is possible under many mortgages before the judgment. A deed in lieu of foreclosure, if the lender accepts it, transfers the home to the lender without a sale but also without equity to you. A short sale, if the lender approves, lets you sell for less than the payoff. A bankruptcy filing generally pauses the case under federal law, though exceptions apply and a court can lift the pause. Each of these depends on someone else's decision, and eligibility and cost vary. A HUD-approved housing counselor can walk through them with you for free. We will give you a cash figure so that whatever you decide, you decide it with a real number in hand.
Timing in Clearwater, and what to do this week
If you have received a breach letter but no lawsuit, you have the most room, and a sale can close in about a week once title work is done. If you have been served, note the twenty-day response deadline and the case number, and contact us when you are ready; we can contract while the case proceeds. If a judgment has been entered and a sale date set, the title company can often still close before the sale if the payoff, the title search and any court steps come together in time, but every day matters and the payoff figure must be requested immediately. If the certificate of sale has been filed and the judgment set no later deadline, the redemption right has ended and a sale by you is no longer possible; an attorney can confirm which applies. Whatever stage you are in, gather the lender's letters and any court papers and send us the address; the first step costs nothing and gives you a real number, and an independent attorney can explain your legal position and deadlines.
Frequently asked questions
Can I sell my Clearwater house after the lender has filed for foreclosure?
Yes. Florida foreclosure is a court process, and you can sell and pay off the judgment until the Clerk files the certificate of sale or a later deadline in the judgment. Once the lender is paid, its attorney cancels the sale and dismisses the case.
How much time does the Pinellas County foreclosure process take?
Months. The lender must file, serve you, and obtain a judgment; the sale is then set 20 to 35 days after the judgment under Florida law. Contested cases take longer, and the court's calendar and the lender's attorney set the pace.
What if I owe more than the house is worth?
Then the lender must approve a short sale, where it accepts less than the payoff and releases its lien. Ask for the approval letter to waive any deficiency in writing; without that, Florida allows the lender to pursue the balance within the statutory limits.
Will selling stop the foreclosure from appearing on my credit?
The missed payments are already reported. If the sale closes before a judgment is entered, no foreclosure judgment or sale is added. A judgment already entered is not erased by the sale, and credit outcomes cannot be guaranteed.
Do you buy flood-damaged homes that are also in foreclosure?
Yes. Homes in Island Estates and on the bayside that flooded in Helene or Milton and then fell behind are a common situation, and the condition is priced into the written offer.
